State v. C.T.
Client was charged with DUI in violation of O.C.G.A. 40-6-391, and Hit and Run in violation of 40-6-270 after striking several vehicles, and not stopping. Client was stopped by the police, and failed all of the standardized field sobriety evaluations. Client failed all National Highway Traffic Safety Administration (NHTSA) standardized field sobriety tests (SFST's) including the Horizontal Gaze Nystagmus (HGN), 9 Step Walk and Turn (WAT), the One Leg Stand (OLS), and the Preliminary Breath Test (PBT) on the Alco Sensor IV. Officer also noticed the client had a strong odor of an alcoholic beverage coming from the client's person, the client had glassy, bloodshot eyes, and slurred speech. The client submitted to the state administered test of her breath on the Intoxilyzer 5000, and blew a .254 which is more than 3 times the legal limit of 0.08 in Georgia. DUI, Hit and Run, and all charges dismissed.

State v. H.T.
Client was arrested for DUI in violation of O.C.G.A. 40-6-391 after she drove around a mechanical arm to get out of a parking deck without paying, she struck a building, then struck a guard rail, then drove the wrong way down a one way street, and struck 3 parked cars. Witnesses testified client was in a nearby bar drinking, and that they saw her staggering down the street to get into her vehicle. Client found not guilty on all charges, including DUI and Driving the Wrong Way On A One Way, after trial.

The officer felt that she was not cooperating, and charged her as a DUI refusal under O.C.G.A. 40-6-391. DUI and all charges dismissed.

State v. J.S.
This was client's second Driving Under the Influence (DUI) charge in 5 years in violation of O.C.G.A. 40-6-391.  Client stopped for speeding in a high crash zone in violation of O.C.G.A. 40-6-181 by a DUI Task Force police officer.  Officer noticed client had a strong odor of an alcoholic beverage coming from the client’s person.  The arresting officer also noticed the client had glassy and bloodshot eyes as well as slurred speech.  The client refused to submit to a state administered chemical test of his breath after being read the Georgia Implied Consent Notice.  Client was facing a minimum of 6 months in jail if convicted. Client was found not guilty of the DUI charge after a jury trial.
